Título: A argumentação em crimes via telefone sob a perspectiva da teoria semiolinguística
The argumentation in telephonic crimes under the semiolinguistics theory perpective

Abstract: O presente trabalho procura descrever, analisar e entender a forma como os sujeitos participantes de situações de comunicação pertencentes a dois tipos de crimes linguísticos constroem seus argumentos visando a atingir seus objetivos comunicacionais. Para isso, baseamos nossa análise sobre o aparato teórico- metodológico da Teoria Semiolinguística, de Patrick Charaudeau (2012), bem como nos postulados de Perelman e Tyteca (2005) acerca da Nova Retórica. Nosso corpus de pesquisa consiste de 06 (seis) gravações telefônicas oriundas de interações de golpes do falso sequestro e 03 (três) gravações de golpes da recarga premiada, todas conseguidas através da rede mundial de computadores. Após a transcrição do material sonoro, fizemos a descrição e configuração dos gêneros situacionais Golpe do Falso Sequestro e Golpe da Recarga Premiada, os vinculando ao que chamamos de domínio de comunicação do discurso criminoso. A análise foi pautada sobre os argumentos de base racionalizante, classificados a partir da nomenclatura de Perelman e Tyteca (2005), sobre os argumentos patêmicos, relacionados à estratégia discursiva da captação, e sobre os ethé discursivos que foram construídos visando a garantir a legitimidade do sujeito argumentante e a credibilidade de seus argumentos. Pudemos notar que a maior parte dos argumentos racionalizantes diz respeito ao vínculo causal e ao argumento pragmático, já que a explicação acerca do que poderia acontecer caso as vítimas não fizessem o que lhes foi pedido, bem como do porquê de se fazer, é uma constante nas duas situações de comunicação. Observamos também a predominância de argumentos patêmicos que procuram despertar o temor e a piedade, nos golpes do falso sequestro, e a alegria nos golpes da recarga premiada. A respeito do ethos, notamos que as construções de ethé de potência foram as mais recorrentes nos golpes do falso sequestro, enquanto que os ethé de competência foram encontrados apenas nos golpes da recarga premiada. O ethos de virtude, por sua vez, foi construído nos dois gêneros. Os resultados demonstram que a utilização de determinados argumentos racionalizantes e patêmicos, bem como as construções dos ethé acima elencados, estão de acordo com as finalidades das situações de comunicação aqui analisadas, a saber: convencer as vítimas acerca da veracidade dos argumentos utilizados pelos criminosos.
The aim of this research is to describe, analyze and understand the way people who practice the fake kidnapping and the lucky cellphone recharge scams build their arguments to get to their communicative goals. For that, we based our analysis on the Semiolinguistics Theory of Patrick Charaudeau (2012) and on the postulates of Perelman and Tyteca (2005) about the New Rhetoric. Our corpus is composed by 06 (six) records of fake kidnapping scams interactions and 03 (three) records of lucky recharge scams. These records were obtained on the internet. After the transcription of the sound material, we made the description and configuration of the afore mentioned material, considering it as a genre in itself, both the Fake Kidnapping Scams and the Lucky Recharge Scams, linking them to what we are calling the criminal communication domain. The analysis was based on the logic arguments, classified according the nomenclature of Perelman and Tyteca (2005), on the pathemic arguments, linked to the discursive strategy of the capitation, and on the discursive ethé that was build with the intention of ensuring the legitimacy of the subject who argues and the credibility of their arguments. We realized that the most part of the logic arguments concerns to the causal linkand and to the pragmatic argument, due to the explanation about what could happen if the victim did not make what was asked of them, and, therefore, that being reason to do it, is a constant in the two communication situations. Furthermore, we realized the predominance of pathemic arguments linked to fear and compassion in the fake kidnapping scams and pathemic arguments linked to happiness in the lucky recharge scams. About the ethos, we realized the ethé of potence were the more repeating in the fake kidnapping scams, while the ethé of competence were found just in the lucky recharge scams. By its turn, the ethos of virtue was built in the two genres. The results shows that the utilization of certain logic and pathemic arguments, and the building of the ethé listed above, concurs with the goal of the communication situation analyzed in this research: to convince the victims about the veracity of the arguments used by the criminals.
