Ambivalência social e direito: uma leitura baumaniana sobre danos colaterais e estranhamento em uma sociedade plural

Abstract

Vive-se hodiernamente no Estado Democrático de Direito. A expressão refere-se ao Estado em que a Democracia é associada e vinculada a direitos mínimos, confeccionados pelo Poder Legislativo, realizados pelo Poder Executivo, sob análise contínua do Poder Judiciário, que se incumbe de dirimir conflitos de interesse das mais variadas matizes. Neste Estado de Direito, todos aqueles que nele residem – e em alguns casos, pessoas que nele se encontrem – são dotados da prerrogativa de exigirem o implemento de direitos fundamentais. Todavia, essa obviedade não é confirmada na realidade social. Exclusão, descaso e indiferença parecem ser as características essenciais presentes em algumas realidades sociais que, cotidianamente, afastam classes – ou subclasses – da abrangência da tutela estatal. Estes segmentos alijados da proteção estatal são lidos por Bauman como “estranhos”, representam ambivalência social, e sujeitam-se, em muitos casos, aos danos colaterais. O problema de pesquisa desse artigo perpassa pela verificação da compatibilidade dos conceitos trabalhados por Bauman com o Estado Democrático de Direito. O objetivo desse artigo é conceituar ambivalência social, estranhamento e danos colaterais de acordo com o pensamento de Bauman e, após, verificar no incidente de um jovem preso a um poste a seletividade forjada no seio social, e sua relação com o Direito. O método de trabalho é a conjugação de análise bibliográfica com estudo de caso, que aqui representará instrumento qualitativo. A hipótese aventada é a de que em um Estado Democrático de Direito a segregação vislumbrada na realidade social não pode ser amparada pelo Ordenamento Jurídico. Assim, o pano de fundo da análise são as constantes ondas de prática da justiça privada que trazem à tona o fenômeno da institucionalização da segregação e estranhamento na sociedade atual, requerendo uma percepção acurada entre a imbricada relação Direito-Sociedade.

However , this truism is not confirmed in social reality. Exclusion, neglect and indifference seem to be the essential features present in some social realities in everyday life away from classes - or subclasses - the scope of state protection . These disenfranchised segments of state protection are read by Bauman as “ strange “ , represent social ambivalence , and subject themselves , in many cases , the collateral damage . The research problem of this article goes through the verification of the compatibility of concepts developed by Bauman with the democratic rule of law . The aim of this paper is to conceptualize social ambivalence , alienation and collateral damage according to Bauman , and after checking in the incident of a young man tied to a pole selectivity forged in social sinus, and its relationship with the law . The working method is a combination of literature review with case study , which here represent qualitative instrument. The mooted hypothesis is that in a democratic state envisioned segregation in social reality can not be supported by the legal system . Thus , the background of the analysis is the constant waves of private practice of justice that brings to light the phenomenon of institutionalization of segregation and alienation in modern society , requiring an accurate perception intertwined relationship between the Law - Society .
