União homoafetiva e conjugalidade: a construção social de novos arranjos familiares

Abstract

O trabalho problematizou a união de duas pessoas do mesmo sexo biológico que se relacionam afetiva e sexualmente. União esta denominada, nesta dissertação, união homoafetiva. A problematização foi levantada a partir de um dialógo com o campo da Antropologia, da Sociologia e do Campo Jurídico. Entendeu-se a família como um modelo social sempre em construção, que pode e deve ser apropriado como uma categoria analítica, não sendo possível fornecer conceitos prontos e acabados. Diversas formas de família podem ser visualizadas, dependendo do espaço, do lugar e do tempo considerado; pode-se dizer que diversos arranjos familiares coexistem. Nesse contexto analítico, é reconhecido um dos novos modelos de arranjo familiar: as uniões de duas pessoas do mesmo sexo biológico, que se relacionam afetiva e sexualmente, dando origem às uniões homoafetivas. Nesta dissertação, contextualizou-se a família como modelo social, pensando-a como uma categoria analítica e modelo social, verificando o tratamento concedido-lhe pelo campo jurídico, o que foi necessário para identificar quais são os arranjos reconhecidos como família pelo direito, investigando-se como ficam os demais arranjos que não são assim considerados. Em termos jurídicos, quando o Estado se apropria da terminologia família, disciplinando-a por intermédio de suas leis, conseqüentemente exclui de sua tutela jurisdicional outras modalidades de arranjos familiares, em especial as uniões homoafetivas. Com base numa abordagem qualitativa, foi realizado um estudo de caso, valendo-se da entrevista semi-estruturada e de observação direta. Os dados construídos foram interpretados via análise de conteúdo. Com base nesse material, pôde-se perceber que os casais homoafetivos, na maioria dos casos, identificam-se socialmente como uma modalidade de arranjo familiar e, assim, buscam o reconhecimento da sua união, postulando uma regulamentação jurídica legal que possa ser utilizada nos impasses que ocorrerem. Verificou-se que a união homoafetiva ainda possui resistência das famílias, do ambiente de trabalho e da sociedade. As narrativas construídas indicam, na perspectiva local, que, se as pessoas assumissem a opção sexual, alguns preconceitos poderiam ser evitados, e isso acabaria por facilitar o reconhecimento jurídico da união, pois seria possível perceber que a união homoafetiva é situação vivenciada por diversas pessoas da sociedade. Esta dissertação aponta para a necessidade de estudos mais aprofundados, repensando a família dentro do contexto social atual, verificando a possibilidade de as uniões homoafetivas serem vistas como novos sujeitos de direito, merecendo, pois, o reconhecimento e a atualização do campo jurídico.

The work problematizou the union of two persons of the same biological sex that relate affective and sexually. This Union, called the union homoafetiva this dissertation. The problematization was raised from a dialógo with the field of anthropology, sociology and the legal field. It is the family as a social model always under construction that can and must be suitable as an analytical category and is not possible to provide ready and finished concepts. Various forms of family can be viewed depending on space, the place and time considered, we can say that several family arrangements coexist. In this context analytical, we recognize one of the new types of family arrangements, the unions of two people of the same biological sex that relate affective and sexually, giving rise to homoafetivas unions. In this dissertation, contextualizou to the family as a social model, thinking it as an analytical category and social model, noting the treatment accorded to it by the judicial field, which was necessary to identify what are the arrangements recognized as family by the law, noting themselves as are the other arrangements that are not considered. In legal terms, when the state to appropriate the terminology family, disciplinando it through its laws, therefore, exclude their judicial protection of other methods of family arrangements, especially the unions homoafetivas. Based on a qualitative approach was conducted a case study, worth up of semi-structured and direct observation. The data were interpreted constructed by analysis of content. On the basis of this material could be realizing that, the couples homoafetivos, in most cases, identify themselves socially, as a method of family arrangement, and thus seek the recognition of their union as such, postulando a legal regulations that legal can be used in deadlocks that occur. We identified that the union still has strength of homosexual families, the work environment and society. The narrative constructed in the local perspective indicate that if people take the option sex, some prejudices could be avoided and this would facilitate the legal recognition of the union because it would be possible to perceive that the union homoafetiva, covers situation experienced by many people from society. This dissertation points to the need for further studies, and reconsidered the family within the current social context, notingthe possibility of unions homoafetivas be seen as new subject of law, deserving therefore the recognition and upgrade the judicial field.
